Indonesia Introduces New Regulations for Expedited Customs Release of Imported Goods

The Ministry of Trade Regulation ("MOT Regulation") No. 26 of 2024 has been released by the Indonesian government, as an amendment to the Ministry of Trade Regulation ("MOT Regulation") No. 74/PMK.04/2021. The regulation is about the release of imported goods through the expedited processing mechanism and will be put into force on May 29, 2024.

Several items have been added to the list of commodities that can be processed more quickly as a result of the amendments, such as fresh-cut plants (flowers, leaves, branches, or other plant parts), fish, either fresh or chilled, and meat other than fish (fresh or chilled).

Importers must give the appropriate customs authorities a guarantee if they wish to release imported goods under the accelerated processing procedure. A guarantee may be given in the form of cash, bank guarantees, an insurance company guarantee, an Indonesian Export Financing Agency (LPEI) guarantee, a guarantee from a guarantee institution, etc.

It is also important to remember that the guarantee amount must be at least equivalent to the amount of entrance duty, excise duty, value-added tax, luxury sales tax, and so on.

The new amendment states that a selected, risk-based physical inspection would be performed on all imported products issued under the accelerated processing mechanism.

Furthermore, regarding the deadline for approving the release of imported products, approval for imports mentioned in the previous rules and modifications must be granted in two hours, and clearance for imports not on the list must be granted in five hours.

The amendment further stated that, subject to meeting specific requirements, all imported items sought for release under the accelerated processing method may be partially released without requiring the submission of an application.
