Recently, the High Court of Hong Kong issued a winning judgment, ordering the defendant, a subsidiary of a European telecommunications company in Hong Kong, to pay RH’s client, a mainland Chinese telecom company, more than RMB 13 million in network service fees and interest, as well as other losses and court costs caused to RH's client.
The defendant, a subsidiary of a European telecommunications company in Hong Kong, had defaulted on a large amount of network service fees owed to RH’s client since mid-2021. Due to the turnover of the client's business personnel, some documents were missing, making evidence collection challenging. After preliminary analysis and assessment, the RH team filed a lawsuit on behalf of the client in the High Court of Hong Kong at the end of 2022, requesting the court to order the defendant to pay more than RMB 13 million in network service fees and other losses and court costs. The defendant first applied to the court for a 42-day extension to submit the defense and counterclaim documents in January 2023, citing the large number of documents and the complexity of the case. The RH team, representing the client, agreed to a 28-day extension and obtained court approval. The defendant again applied to the court for a 28-day extension in February 2023. The RH team, representing the client, argued persuasively, eventually convincing the court to issue a final deadline order, requiring the defendant to submit the defense and counterclaim documents by early March 2023. Recently, the High Court of Hong Kong issued a winning judgment, supporting the plaintiff's claims. The RH team has applied to the court for a third-party debtor order to enforce the judgment on behalf of the client.
